1. Scope

(1) These Terms of Service (hereinafter "Terms") govern the use of the online platform "Bau-Maschinen" (hereinafter "Platform"), operated by Bau-Maschinen (hereinafter "Operator").

(2) The Platform serves as a marketplace for renting, buying, and selling construction machinery and for connecting services in the field of construction machinery.

(3) Deviating conditions of the user will not be recognized unless the Operator expressly agrees to their validity in writing.

2. Contract Conclusion and Use

2.1 Registration

(1) Registration is required to use the Platform. The user agrees to provide truthful and complete information.

(2) Registration is only fully completed after confirmation of the email address.

(3) The Operator reserves the right to reject registrations without giving reasons.

2.2 Use of the Platform

(1) The user is obligated to use the Platform only for lawful purposes.

(2) It is prohibited to publish false, misleading, or illegal content.

(3) The user is solely responsible for all content published by him on the Platform.

3. Listings

3.1 Publication of Listings

(1) The user can create, edit, and delete listings for construction machinery on the Platform.

(2) Listings must correspond to facts and may not contain misleading information.

(3) All listings are subject to moderation by the Operator. The Operator reserves the right to reject or delete listings without giving reasons.

3.2 Premium Listings

(1) The user can create premium listings for a fee that receive increased visibility.

(2) Fees for premium listings must be paid before publication.

(3) A refund of already paid fees will only be made in exceptional cases and at the Operator's discretion.

4. Liability

4.1 Operator's Liability

(1) The Operator is not liable for the accuracy, completeness, or timeliness of content posted by users.

(2) The Operator does not guarantee the quality, safety, or legality of construction machinery or services offered through the Platform.

(3) The Operator is not liable for damages arising from the use of the Platform, unless the damage was caused by intentional or grossly negligent behavior of the Operator.

4.2 User's Liability

(1) The user is liable for all content published on the Platform.

(2) The user indemnifies the Operator from all claims of third parties that arise due to legal violations by content posted by the user.

5. Payments

(1) Fees may be charged for certain services on the Platform (e.g., premium listings).

(2) Payment is made through the payment methods offered by the Platform (e.g., credit card, PayPal).

(3) Fees become due at the time the respective service is used.

(4) The Operator reserves the right to change prices and fees at any time. Contracts already concluded remain unaffected.

6. Intellectual Property

(1) All rights to the Platform, including the software used, trademarks, logos, and designs, belong to the Operator.

(2) The user grants the Operator an irrevocable, temporally and spatially unrestricted, non-exclusive right to use, store, reproduce, and make publicly accessible the content published by him on the Platform.

7. Blocking and Termination

(1) The Operator can block or delete a user's account without prior notice if the user violates these Terms or violates legal provisions.

(2) The user can terminate his user account at any time by contacting the Operator.

(3) After termination or blocking, the user has no right to a refund of already paid fees.

8. Dispute Resolution

(1) German law applies to the contractual relationship between the Operator and the user, excluding the UN Sales Law.

(2) If the user is a merchant, legal entity under public law, or special fund under public law, the exclusive place of jurisdiction for all disputes arising from this contract is the Operator's place of business.

(3) The Operator is willing to participate in a dispute resolution procedure before a consumer arbitration board.

9. Final Provisions

(1) Should individual provisions of these Terms be or become invalid, the validity of the remaining provisions remains unaffected.

(2) The Operator reserves the right to change these Terms at any time. Changes will be communicated to the user in a timely manner.

(3) Continued use of the Platform after notification of changes is considered consent to the modified Terms.
